General Conditions "La Chatelaine"
To pay for your stay: If you live in France: you can pay for your stay by credit card (Carte Bleue, Visa, Mastercard, etc.), by Paypal at the address lachatelaine91@yahoo.com, by bank or postal check to the order of Cathy Kuyper, by IBAN transfer. If you live abroad: by international bank card (Visa, Mastercard, etc.) or by IBAN transfer. Send your payment with your signed rental contract by mail.
Article 1 - Duration of stay : The customer signing this contract concluded for a fixed period may not under any circumstances claim any right to remain in the premises at the end of the stay.
Article 2 - Liability : The booking service which offers services to a client is the sole interlocutor of this client and answers to him for the performance of the obligations arising from these conditions of sale. The reservation service cannot be held responsible for fortuitous events, cases of force majeure or the actions of any person unrelated to the organization and progress of the stay.
Article 3 - Reservation : The reservation becomes firm when the service receives a deposit corresponding at 25% of amount of the rent and a copy of the signed contract by the customer before the deadline indicated on the front.
Article 4 - Absence of withdrawal : For reservations made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, in accordance with Article L121-20-4 of the Consumer Code relating in particular to provision of accommodation services provided on a date or according to a determined periodicity.
Article 5 - Payment of the balance : The customer must pay the booking service the balance of the agreed service and remaining due, and this one month before the start of the stay. The customer who has not paid the balance on the agreed date is considered to have canceled his stay. Therefore, the service is again offered for sale and no refund will be made.
Item 6 - Late registrations : In case of registration less than 30 days before the start of the stay, the full payment will be required upon reservation.
Item 7 - Arrival : The client must arrive on the day specified and at the times mentioned in this contract or on the acknowledgment of receipt. In the event of late or deferred arrival or last-minute impediment, the client must notify the service provider (or owner) whose address and telephone number appear on the contract.
Item 8 - Cancellation by the customer : Any cancellation must be notified by registered letter to the reservation service.
a/ You have cancellation insurance: refer to the attached insurance sheet.
b/ You do not benefit from cancellation insurance : for any cancellation by the customer, reimbursement by the booking service is made as following :
- cancelation up to and including the 21st day before the start of the stay: the amount of the deposit as defined in article 3 will be retained and the balance will be refunded if it has been cashed on the date of cancellation.
- cancellation between the 20th and the 8th day inclusive before the start of the stay: 50% of the amount of the rent will be retained.
- cancellation between the 7th and 2nd day inclusive before the start of the stay: 75% will be retained the amount of the rent.
- cancellation the day before or the day of arrival initially provided for in the contract or no-show: no refund will be made.
Article 9 - Modification of a substantial element : When, before the scheduled date of the start of the stay, the booking service is forced to make a modification to one of the essential elements of the contract, the buyer may, and after have been informed by the seller by registered letter with acknowledgment of receipt:
- - or terminate his contract and obtain, without penalty, the immediate reimbursement of the sums paid.
- - or accept the modification proposed by the seller (date, price): an amendment to the contract specifying the modifications made is then signed by the parties.
Any reduction in price is deducted from any sums remaining due by the buyer and if the payment already made by the latter exceeds the price of the modified service, the overpayment will be returned to the tenant before the start of his stay.
Article 10 - Cancellation by the seller . When, before the start of the stay, the booking service cancels this stay, it must inform the buyer by registered letter with acknowledgment of receipt. The buyer will be reimbursed immediately and without penalty for the sums paid. These provisions do not apply when an amicable agreement has been concluded with the object of acceptance by the buyer of a substitute stay proposed by the seller.
Article 11 - Interruption of the stay : In the event of interruption of the stay by the client, no reimbursement will be made by the lessor.
Article 12 - Capacity : This contract is established for a maximum capacity of people. If the number of holidaymakers exceeds the accommodation capacity, the service provider may refuse additional customers. Any modification or termination of the contract will be considered at the customer's initiative.
Article 13 - Assignment of the contract by the customer : The buyer can assign his contract to a transferee who fulfills the same conditions as him to carry out the stay. In this case, the buyer is required to inform the reservation service of his decision by registered letter with acknowledgment of receipt no later than 15 days before the start of the stay. The transfer of the contract must be made at cost price. The assignor and the assignee are jointly and severally liable vis-à-vis the seller, for the payment of the balance of the price as well as any additional costs occasioned by this assignment.
Article 14 - Insurance : The customer is responsible for all damages arising from his fault. It is required to be insured by a resort-type insurance contract for these various risks.
Article 15 - Inventory : An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure from the gîte. This inventory is the only reference in the event of a dispute concerning the inventory. The tenant is required to enjoy the rented property as a good father. The state of cleanliness of the lodging on the arrival of the tenant must be noted in the inventory. The cleaning of the premises is the responsibility of the holidaymaker during the rental period and before his departure. The amount of any cleaning costs is established on the basis of calculation mentioned in the description sheet.
Article 16 - Animals welcome: Animals are not accepted.
Item 17 - Security deposit : When the customer makes a reservation, a security deposit, the amount of which is indicated on the description sheet, is requested by the owner. After the contradictory establishment of the exit inventory, this deposit is returned within 15 days, after deduction of the cost of restoring the premises if damage was noted. In the event of early departure (prior to the hours mentioned on the description sheet) preventing the establishment of the inventory of fixtures on the day of the tenant's departure, the security deposit is returned by the owner within a period not exceeding 15 days. .
Article 18 - Payment of charges : At the end of the stay, the owner reserves the right to demand payment for abnormally high consumption of water, electricity or fuel oil. The resulting charges must be paid on the day of departure.
Article 19 - Disputes : Any complaint relating to the inventory of fixtures and the inventory of descriptions during a rental must be submitted to the booking service within 3 days of entering the premises. Any other complaint must be addressed to him as soon as possible, by letter. In accordance with the “Informatique et Libertés” law, the personal information in the reservation file is mandatory. A right of access and rectification can be exercised with the reservation service.
